Probate is the process where a court approves a Will as valid (testate), or if someone dies without a Will, the laws of Intestacy applies and the estate will be administered under the laws of intestacy.
We assist in the probate of estates in the Probate and Family Courts. Services include seeking judicial authority to allow a will, or to determine heirs if someone died without a will. We assist in getting the correct person appointed by the court as the Personal Representative of the Estate (formerly known as Executor).
We will also assist the personal representative in collecting and managing assets of the estate, the sale of real estate, and assist in preparing the inventory and account for the estate.
A Will is a legal document that sets forth your wishes regarding the distribution of your all of your property. A Will also names a Personal Representative (fka Executor in MA) and describes their powers, and nominates guardians for your minor children. If you die without a Will, your wishes might not be carried out as you intended. Without a Will, your heirs or intended beneficiaries may end up spending additional time, money, and emotional energy to settle your affairs in Court after you're gone.
We can help set up a properly drafted and executed Will to enable you to make it clear who gets your assets, including who gets what and how much. You can keep your assets out of the hands of people you don't want to have them such as an estranged relative.

Guardianship is a legal process that grants the guardian authority to care for and make decisions on behalf of an incapacitated adult or a minor child. An incapacitated person is someone with a clinically diagnosed condition that leaves them unable to make or communicate decisions affecting their health, safety, or welfare. We handle Guardianship Petitions and Conservatorship Petitions.
